【摘要】位一体的、整体的、渐进的移植策略对日本明治维新时期法律移植的重要影响。其后分别就日本明治维新时期的法律规范、司法制度以及移植司法制度运作的主体的辅助手段——法律教育的情况进行了简要的介绍,分析了三者在移植过程中的各自特点。基于以上的分析,对日本明治维新时期法律移植的成败进行评价,进一步得出对我国当代法律改革的启示。

【外文摘要】 This paper analyses the background, strategy, and content of Laws Transplantation in Meiji reform to find out why Japan succeeded, and use it for reference for Chinese Laws Transplantation. Introduction educes Chinese Laws Transplantation from the legislation of Civil Code and Real Right Act. The most successful Laws Transplantation in the world happened in Japan.
